REPORT OF DISCHARGING INTO WATER SOURCE

1. What is report of discharging into water source?

Scheme/report of discharging into water sources is an environmental dossiers that entrepreneurs must prepare if their business activities generate wastewater larger than 5 m3/day. Accordingly, making a scheme of discharging wastewater into a water source in case they haven’t yet had discharge activity and reporting the current state of wastewater discharge in the case they are doing discharge activity. Preparing a waste discharge report and applying for confirmation so that the Environmental and water resource management agency understands and manages the situation of water resources in the area as well as controls the environmental pollution effects of the discharge unit.

2.  Who must apply for discharge permits?

In accordance to the regulations of Decree 201/2013/BTNMT and Circular 27/2014/BTNMT, the following entities must prepare wastewater discharge reports:

- Establishments of production, business and services discharge wastewater with the scale of over 5 m3/day.

- Weaving and textile; garment which has dyeing stage and pattern printing; washing with bleaching stage;

- Metallurgy, metal recycling, metal plating; manufacturing electronic components;

- Treatment and recycling of industrial waste; leather tanning, leather recycling;

- Processing minerals with chemicals; gasoline refineries; Processing petroleum products.

- Pulp and paper manufacturing; plastics, rubber, detergents, additives, fertilizers, chemicals, pharmaceuticals, oriental medicine, cosmetic chemicals, plant protection drugs; batteries, accumulators; bamboo, rattan, wood processing with chemical impregnation; processing tapioca and monosodium glutamate;

- Medical examination and treatment that generates medical wastewater;

- Performing experiments of using chemicals and radioactive substances.       

3. Who doesn’t need to apply for discharge permit?

- Wastewater from domestic activities of individuals and households;

- Wastewater from production, business and service establishments with the capacity which is not exceeding 5m3/day and contain no harmful chemicals or radioactive substances.

- Wastewater from production, business and service establishments into the centralized wastewater collection and treatment system which has been licensed and have an agreement or contract on wastewater treatment and drainage with organizations and individuals that manage and operate the centralized wastewater collection and treatment (Unit: Industrial park, building of processing service,...)

4. Subjects need to repeat waste discharge profile

In the discharge permit, there are contents that cannot be changed, modified, if there is a change in the following cases, the permit holder must apply for the new license:

- Name of the license holder;

- Which water source for exploitation and use; water source receiving wastewater;

- The amount of water to be exploited and used exceeds 25% specified in the granted permit;

- The amount of water discharged exceeds 25% specified in the issued permit;

- Parameters and concentrations of pollutants specified in the wastewater discharge permit.

5. Term of the license and period of extension

The duration of the license does not exceed 10 years to be considered and extended for no more than 5 years. The moment of applying for renewal of the old discharge permit, its valid time is no less than 3 months.

6. Relevant legal documents

- Law on Water Resources No. 17/2012/QH13 dated June 21st, 2012;

- Decree 201/2013/ND-CP dated November 27th, 2013 of the Government detailing a number of articles of the Law on Water Resources;

- Decree No. 80/2014/ND-CP dated August 6th, 2014 of the Government on drainage and wastewater treatment;

Circular 27/2014/TT-BTNMT dated 30th May 2014 of the Ministry of Natural Resources and Environment regulating the registration of groundwater extraction, form of application, extension, re-grant water resource permits;

- Circular No.02/2009/TT-BTNMT dated March 19th, 2009 of the MORNE regulates the assessment of the wastewater reception capacityof water sources;

- Circular 56/2014/TT-BTNMT dated 242/9/2014 of the MORNE regulating the conditions and capacity of organizations and individuals to carry out basic survey on water resources, consulting plan on water resources, preparing scheme, report in the dossier of application for water resource permit.

7. Content of applying for discharge permit

- Surveying and collecting data on production technology of enterprises and of production facilities.

- Identifying the pollutant sources of the project such as solid waste, emission, wastewater and noise, ... Finding out about other types of waste generated during construction and operation of the project.

- Evaluating and remarking on the amount of impacts from pollution sources.

- Identifying demand for water use and water discharge.

- Identifying the characteristics of the wastewater source and the operational wastewater treatment system.

- Collecting samples of influent and effluent from businesses, companies, ... and carefully analysing them in the laboratory.

- Demonstrating of wastewater treatment works: discharge mode, discharge method, discharge flow, ...

- Accessing, collecting, statistics, sampling wastewater, ... businesses and factories discharge  within a radius of 1 km around the discharge source.

- Stating the characteristics of the receiving source of wastewater such as rivers, canals, streams, ... which receive wastewater with hydrological mode.

- Remarking and assessing on activities related to both natural and socio-economic receiving source.

- Taking water samples in canals and creeks for wastewater (direct receiving source) at different locations and analysis in the laboratory.

- Sampling water in the final receiving river at different locations and according to the hydrological mode of the water flow, then analysing them.

- Assessment of the quality and the receiving capacity of the receiving water.

- Assessing the impact of waste discharge of enterprises, production establishments on water sources.

- Creating a map of the location of wastewater discharge to the receiving water source with the scale of 1/10,000.

- Creating survey diagrams, taking samples for analysis.

8. Record for evaluation 

An application for a permit for discharge into water sources includes:

- Application for licensing;

- Preparing scheme of discharging wastewater into water sources enclosed with the process of operating wastewater treatment system in case the wastewater has not yet been discharged; Wastewater discharge report  enclosed with the operating procedures of the wastewater treatment system in case wastewater is being discharged into water sources;

- Results of analyzing the quality of the receiving water at the location where the wastewater is discharged into the water source; results of analysis of wastewater quality before and after treatment in case of wastewater discharge. The time for taking samples for water quality analysis is not more than three (03) months from the time of submission;

- Diagram of the location of the wastewater discharge area.

 

9. Evaluation time

- Within thirty (30) business days from the date of receivingof a complete and valid application as prescribed in Clause 1 of this Article, the dossier-receiving agency shall evaluate the scheme and report; If necessary, inspect the site, set up a project and report evaluation council. In case the conditions are satisfied, the dossier-receiving agency shall submit it to the licensing agency; in case of being ineligible for licensing, the application shall be returned to the applicant and informed of the reason for not licensing;

- In case of supplementing or modifying to complete the project or report, the dossier-receiving agency shall send a written notice to the applicant, clearly stating the contents to be supplemented for completing projects, reports. The time for supplementing, completion or re-establishment of a project or report is not included in the time for evaluation of projects or reports. The evaluation time after completing projects and reports are twenty (20) business days;

- In case the project or report must be re-granted, the application-receiving agency shall send a written notice to the applicant, stating that the contents of the scheme or report are disqualified, will be returned and must be re-prepared.
