REPORT ON COMPLETION OF WORK OF ENVIRONMENTAL PROTECTION
Report on the implementation of environmental protection works (or report on completion of EIA/EPP/Environmental Protection Scheme)is an environmental document in which production, business and service establishments have been granted EIA approval, certificate of environmental protection plan (for investment projects which is ready to be constructed) and certificate of environmental protection scheme (for projects already in operation) need to be reported on the implementation of the environmental protection works.
The report is submitted to the environmental management agency for inspection and certification before the project goes into official operation, serving as a basis for competent state agencies to examine and inspect the observance of the law on environmental protection during the operation of the project.
1. Legal bases for reporting results of implementation of environmental protection works
Law on Environmental Protection No. 55/2014/QH13 passed by the National Assembly of the Socialist Republic of Vietnam on June 23th, 2014, takes effect from January 1st, 2015;
- Decree 18/2015/ND-CP dated February 14th, 2015 of the Government regulating environmental protection planning, strategic environmental assessment, environmental impact assessment and environmental protection plans.
- Decree 27/2015/TT-BTNMT dated May 29th, 2015 of the Ministry of Natural Resources and Environment on strategic environmental assessment, environmental impact assessment and environmental protection plan.
- Decree 155/2016/ND-CP dated November 18th, 2016 of the Government on Handling of Administrative Violations in the field of environmental protection.
2. Subjects must make reports on completion of environmental protection works
- Projects that are required to report on results of the implementation of environmental protection works are shown in Column 4 in the table of Appendix II - Projects that must implement environmental impact assessment which are issued together with Decree No. 18/2015 / ND-CP dated February 14th, 2015.
- Projects that have been granted EIA certification, Environmental Protection Plan and Environmental Protection Scheme Certificate which have scales and properties equivalent to projects has been specified in Column 2 and are required to make a Report on results of the implementation of environmental protection works corresponding to the scales and properties of the projects at Column 4 in Appendix II.
- The agency competents to inspect and certify the completion of environmental protection works is the agency that approves and certifies the environmental impact assessment report, environmental protection plan or environmental protection scheme.
3. The report on the results of the environmental protection works
An application for reporting on results of environmental protection works for project's operation phase includes:
- One (01) written request for inspection and certification of completion of environmental protection works;
- One (01) copy of the approval decision with a copy of the approved project's report on impact assessment/environmental protection scheme.
- Seven (07) reports on results of environmental protection works for the project's operational phase.
4. Content of report on completion of environmental protection works
The content of the report presents the environmental protection works that have been invested in the construction includes:
- Waste water collection and treatment works;
- Works for dust, emission treatment; solid waste storage and treatment works;
- Hazardous waste storage and treatment works;
- Works of environmental incident prevention and response, environmental protection works as well as trial operation results of waste treatment works, specifically such as:
a) Wastewater treatment works
+ Demonstration of technical specifications of the water collection and drainage system; location of these works with illustrative diagrams;
+ Wastewater treatment works that have been built and installed: detailed the technological process, capacity scale, technical specifications of the works, the equipment that has been installed to meet the required of wastewater which is generated from the project and the quality of treated wastewater meets the permitted standards;
+ Results of trial operation of wastewater treatment works.
b) Dust treatment works
+ A full list of installed works and measures to treat dust and emission;
+ Efficiency and origin of installed equipments
+ The results of trial operation of dust and emission treatment works.
c) Solid waste storage and treatment works
Demonstration of solid waste storage works; stating in detail the scale and technical specifications enclosed with detailed designs of solid waste treatment facilities in case project owners handle the work themselves.
d) Hazardous waste storage and treatment project
Demonstration of the hazardous waste storage facility, stating in detail the scale and technical specifications attached to the detailed design of the waste treatment facilities in case the project owner handles the work themselves.
e) Works for prevention and response to environmental incidents
+ Appendix which enclosed to the reports on results of implementation of environmental protection works for the operation phase of the project, includes:
+ Technical drawings or documents explaining the environmental protection works;
+ Certifications and accreditation of environmental treatment equipments which were imported synchronously or commercialized;
+ The sheets of measurement and analysis results of trial operation of waste treatment works;
+ Minutes of acceptance of environmental protection works or other available documents that
related to environmental protection works.
